supreme court is keeping former president trump's name on the colorado ballot for now this after the state supreme court ruled him ineligible. now the u.s. supreme court will review that decision removing his eligibility in a politically charged constitutional fight that's got major implications for the 2024 presidential election. fox news chief legal correspondent and anchor of "fox news sunday" shannon bream joins me now. good evening, shannon. >> shannon: all right, so gillian. good to see you don't. the u.s. supreme court we consider this moving at lightning speed. arguments held on this case february 8th. based on what just happened the justices formally getting involved. colorado will include president trump's name on the primary ballot because the secretary of state had made clear that today is the deadline for her to certify the names for the ballot. and she would do so unless the supreme court upheld the colorado's supreme court ruling other declined to take the case. they are taking the case that means president trump's name stays on the ballot. why did the high court get

involved? well, likely because there are numerous other states considering these same issues under the 1st amendment with maine's secretary of state already indicating -- by the way citing the colorado decision that she thinks maine should keep him off the ballot there as well. in urging the court to take up the case this week, the trump legal team argued that allowing the colorado decision to stand would guess enfranchise millions of voters add going allowed to stand it would mark the first time in the history of the united states that the judiciary has prevented voters from casting ballots for the leading major party presidential candidate. now, the group opposing president trump's name being on the colorado ballot also argued to the supreme court saying this: that the state made the right decision, quote: based on the facts found by the trial court, trump's intentionally mobilizing, inciting and encouraging an armed mob to attack the united states capitol on january 6th satisfies the legal definition of, quote, engaging in insurrection. we would expect a decision from the supreme court within weeks.

maybe even days. once again, the supreme court hears those arguments february 8th, gillian. >> gillian: shannon, also understand the court made an important decision on abortion today? >> shannon: they did. they are getting involved in a couple of cases out of idaho. comes down to this: can hospitals there be forced by the biden administration to perform abortions in emergency situations, even if the state has a near total back on abortions with an exception to save the life of the mother. arguments on that case will be held in april. in the meantime, the idaho law will be totally in effect until then. >> gillian: busy night for the court on a friday. shannon, thank you so much. >> good to see you. >> gillian: president biden throwing down the gauntlet against former president trump campaign speech offering a dire warning about a second possible trump turn. sacrificing u.s. democracy in the interest of his own political power. striking a decisively different tone than his 2020 message centering on unity. the political address comes on the heels of the anniversary of

>> biden appealed to voters of all parties to reject trump as a threat to democracy, assailing trump for lauding those reuters as patriots and likening him to hitler. >> echoing the same exact language used in nazi germany. he went on to say he would be a dictator on day one. >> the republican national committee says while families can't pay their bills, children are dying from fentanyl overdoses, terror suspects are crossing the open southern border, biden wants to further divide americans with polarizing rhetoric to distract from his catastrophic policies. biden's economic messaging got a boost today, continued resilience despite interest rate hikes with the u.s. 216,000 jobs in december. the treasury secretary declaring the u.s. has beat the odds of a recession. >> i think we can describe as a soft landing. >> but other challenges persist. even biden allies admit. >> there's a crisis at the border.

ground" segment, we got a pair of congressman, one democrat, one republican who are working together now to help veterans here in america in crisis. here's my colleague, bret baier. >> bret: thanks, gillian. it is time for our "common ground" segment, joining us tonight are illinois republican congressman mike bost. and california democratic congressman mark that con know. congressman, thanks for being here you both are concerned and active on veterans issues being on the veterans affairs committee. i want to put up this chart of suicides from veterans from 2001 to 2021. and you can see the increase there, just in 2021, 6,392 veteran suicide deaths up 114 from the year before. congressman bost, you're working on legislation. you have worked together in a bipartisan way. >> yeah. >> bret: to try to help on this. talk about that. >> no matter what, one veteran

suicide is too many. you know, we have been working to make sure that one our veterans we implemented the new veterans 388 number to make sure veterans can have access to the hotline whenever needed. we expanding and look into each program and the successfulness of each program and also making sure that we're providing and working with our community providers that can provide mental health care early on to meet those needs of our veterans no matter where they are, whether they are close to v.a. or not close to a v.a. we cannot afford to keep that number where it's at. we have got to do everything in our power to bring it down. >> bret: congressman that can know, you all have this compact act under the veterans comprehensive access care. compact act. veterans with acute suicidal crisis can go immediately to any v.a. or non-v.a. healthcare facility for emergency

healthcare at no cost to them. and that seems like a big deal. >> it is a big deal. i am pleased to say that i authored the bill and got it signed into law by president trump in 2020 arched i give the biden administration a lot of credit for also implementing the law and making sure that the 988 number is funded and as chairman bost said, if you are a veteran having an emergency or emeasure jent mental health episode, you are going through suicidal throughout call 9 # 8. you can be connected to mental health care whether it's inpatient or outpatient and you won't have to worry about a bill. if you have served our country and you are a veteran weather enrolled in v.a. or not. don't worry about the bill. just call that number to get help. >> bret: i was saying you all worked on it together. common ground element of the veterans affairs that is now law

and active as you point out. i want to put this up about recruits. that is a lot of concern. department of defense fiscal year 2023. military services collectively missed recruiting goals by about 41,000 that's the 15% down how big a concern is that for readiness, mr. chairman? >> that's a concern. they are encouraged by parents to go into the military. unfortunately some of those parents are not encouraging. i don't know whether it's because of the things with the covid vaccine, the problem that was there and then we brought that back and changed it. i don't know whether it is and not to go political with you the woke positions in the military that these different parents are telling their family not to be involved we need to have our recruits there and serving this country. i'm a marine veteran.

i'm my grandfather, my uncle, my son and my grandson my grandson is now serving. my son is now serving. we got to work to encourage people. our nation can only be secure if we have those people who are willing to, in a volunteer force, step forward to protect and secure this nation. >> bret: and congressman takano, just to leave it here for people who say look up to capitol hill and say nothing getting done and it's a partisan mess and congress doesn't work, you know, what do you say to them? well, i would say look to the veterans affairs committee as a ray of hope. i have worked well with chairman bost. i believe that these recruitment numbers are going to improve. i believe this generation of americans is every bit as patriotic as previous generations. we need to make sure that they know about the tremendous v.a.

now. he has to be careful about also emphasizing what his administration has done and is going to do. otherwise, it risks going too negative too early and is he clearly trying to push into the democracy angle where polls have indicated is he doing better than donald trump that's not so much other top tier issues like the economy and the inflation in democracy, that's why you see him hitting january 6th. that's why you see him hitting charlottesville and he is trying to paint trump as a threat and donald trump is, of course, responding that biden is a threat. >> gillian: so, juan, to that point, critics say that biden should not look backwards, he should not focus on the past. the reality is he is in this unique position where is he running against an opponent, trump, who already served as president. he has got a history. he has got a very long record for folks to consider. >> juan: louisville, this is interesting moment.

we are seeing today. donald trump is in iowa what have you is a moment where the republicans still have a contest going on. the democrats tonight. so this is an opportunity for president biden to get his message out. the key to his message is to remind voters why they threw out donald trump. he was the president as you point out, gillian. they threw him out. he is going to say remember all the chaos. remember what happened january 6th. tomorrow is january 6th. it's an anniversary of that day. is he going to absolutely exploit that for political advantage. >> gillian: president biden was slated to give the speech tomorrow but they had to move it forward a day because of weather spencer. university of maryland poll out. divided along party lines whether the president is to blame for january 6th. whether he deserves responsibility. they're really split clearly along party lines.

not to want to look at any one moment. you want to look at trend lines. >> the trend lines obviously are that we had good holiday spending so people were out spending. people were taking trips, going to restaurants, buying gifts. and the second thing and this underlines it. consumer sentiment going up. we saw it in the stock market. 2024 no recession that could be a bold headline all of us sitting here started last year we were saying boy this economy is kind of wobbly and we don't know if we will go into recession. the recession didn't take place. the economy looked steady. now the question is can consumers change what has been a grumpy, anxious attitude toward that economy and will they change in time for the biden camp going towards november? >> maybe one chip in the president's column something a liability olivia is the crisis along the southern border. another record breaking month seems like we say that every month. this one we saw more than

300,000 illegal migrant crossings for the first time in history. compare that to about the size of the city of pittsburgh. is there anything to be done between now and the year from now? >> i mean, the biden administration knows this is a political liability. and they -- that's why i think they are actively involved in the senate negotiations. they are hoping to have some border policy that can be tacked on to foreign aid to israel, ukraine. taiwan. they keep saying that they are making progress. that's where we have heard a lot. we might see something next week. but, until we see a deal and until we have an idea of speaker mike johnson is okay with it. it's got a tough path. >> gillian: border security is shaping up to be a pretty major election issue, at least among republicans, spencer. take a look at this polling out from the "wall street journal." 54% of voters think trump is better able -- excuse me, is best able to handle this drivers compared to just 24% president
